摘要
健康权是一项基本的人权。自世界卫生组织宪章首次倡导对健康权加以保护的半个多世纪以来,世界上有许多国家已经在宪法中对健康权进行了确认并采取了有效的措施加以保障。在我国公民的健康权一直以来未能得到及时有效的保障。文章拟从人权法的视角关注健康权,并从理论与实践出发探讨国家对公民健康权的实现所承担的基本义务。
Health right is a basic human right. Since WHO Charter firsdy initiated that health right should be protected half century ago, many cotmtries has confirmed health right in their constitutions and take effective measures to ensure it. The health right of citizen of China has been not effectively and timely ensured for long time. From the angle of human right law, this paper paid attention to health right and discussed the government＇s basic obligation to realize health right from theory and practice.
