摘要
近年来,随着诸多"见死不救"事件的出现,使得"见义勇为"与"见死不救"成为当前社会的一个热门话题,并且引发了人们关于道德法律化的思考,能否将"见死不救"入罪的提法也备受各方关注和争议。"见死不救"和"见义勇为"原本都属于道德调整的范畴,可以通过立法来奖励"见义勇为",但法不能将道德推向极致——不能将"见死不救"设定为犯罪行为。
With more and more emergence of ＂Turning away Dying Men＂ cases, the behaviors on ＂Helping Others vouluntrily＂ and ＂Turning away Dying Men＂ becomes a hot topic in recent years, leading people into the moral and law consideration on the disputes whether the behaviors on ＂Turning away Dying Men＂ can be judged as a crime. Actually, the behaviors on ＂Helping Others for A Just Cause＂ and ＂Turning away Dying Men＂ is a moral concept, the behaviors on ＂Helping Others for A Just Cause＂ can be encouraged by legislation, but the law can＇t push such behaviors into the other extreme - - the law can＇t define the behaviors on ＂Turning away Dying Men＂ as crimes.
