摘要
合理使用权作为公众的一项基本权利具有坚实的法理基础,但在网络环境下却面临严峻的危机,因此需要探讨网络著作权合理使用制度的立法范式,重新确立网络著作权合理使用标准,以促成著作权与合理使用权在网络环境下的平衡。
As a fundamental right for people, fair use right has firm base in jurisprudence, but it is facing a serious crisis in cyberspace. It is necessary to investigate the legislative pattern of the system of fair use on internet copyright and enact newly the standards of fair use on internet copyright, for promoting the balance of copyright and fair use right in cyberspace.
