摘要
校规是学校管理学生的主要依据。近年来高校和学生之间频繁发生的诉讼引发许多有关学校校规正当性的讨论。在学校和学生的法律纠纷中,学校校规成为行政和司法审查的主要对象。通过对校规的法律性质和现有缺陷的分析,从内容合法性、道德价值合理性和过程民主性等方面对高等学校的校规进行剖析。
School regulations are the main basis for the management of students. In recent years, the multifarious litigations between the colleges and the students have aroused many discussions about the validity of University Regulations. In the legal dispute between the school and students, the school regulations are considered the priority target reviewed by the administrative organizations and judicial branch. This paper mainly discusses the school regulations in terms of validity of contents, rationality of moral values and democratic essence in process through the analysis of validity argument and existed limitations.
