摘要
隐名投资是当前社会经济生活中客观存在的一种现象,因隐名投资而产生的纠纷及其相关法律问题是立法与司法不容回避的难题。法律调整的前提和基础是明确调整对象的性质和特点,因而有必要区分不同类型的隐名投资行为,深入剖析各情形隐名投资的效力并针对不同的情形采取不同的调整措施。
Dormant investment is a kind of phenomenon existing in current social economical life,disputes and related legal issues arising from dormant investment is the hard nuts to crack facing legislation and jurisdiction. The premise of law adjustment requires making clear the nature and characteristics of then given object,as a result,it is necessary to distinguish all kinds of dormant investment behaviors,analyzing the validity of each dormant investment and adopt different measures to different situations.
