摘要
社团规章是社团成员博弈的产物,必须接受法律控制。但如果法律对社团规章的控制过于严格,将影响社团自治的活力和能力。在保证社会基本法治要求的前提下,应将法律对社团自治的干涉降到最低程度。为此,需引进司法权的介入,同时应以限权审查和程序审查为切入点,以基本法律原则为判断标准,来实现司法对社团规章的有效控制。
Although association rules which are the products of member gaming should be under the control of law, the function of association autonomy will be diminished if law invades too much. The restriction given by law must be set to the lowest level as long as rule by law is assured. So it is necessary to make judicial power control the association rules effectively by power checking and procedure checking with essential legal principles.
