摘要
预告登记是不动产登记中的一项重要制度。预告登记的采纳,对于保障当事人的权利、保护交易安全、维护市场信用具有重要作用。虽然我国新颁布的《物权法》第二十条对预告登记制度的适用范围、发生条件、效力和失效作出了规定,但仍存在一些不足之处。对此,应当借鉴德国、日本和我国台湾地区的立法经验,并结合我国国情对预告登记制度进行完善。
The predicting resignation is a kind of important institutions of the immovable property registration. It is important for the rights of the persons, the security of transference and the credit of economy. The article 20 of the Property Law regulates the range of application, important conditions, effect and invalidation, but it has a little of shortage. We should refer the experience of German, Japan and Taiwan, then, integrate the situation of ottr country to perfect it.
