摘要
预告登记制度是不动产物权变动和登记制度的重要组成部分,对保障债权人的权利,维护市场信用具有重要作用。我国新颁布的《物权法》在第20条规定了预告登记制度,规定了预告登记的适用范围、发生、效力、失效问题,内容相对完整,具有积极意义,但仍有不完善之处。我国预告登记制度的真正有效发挥作用,还需对该制度具体实施制定操作细则。因此,作者对扩大预告登记的适用范围、发生条件、法律效力、预告登记推进的程序等方面提出了立法建议。
The preliminary registration is an important system on transference of the real estate right in civil law.It plays an important role in safeguarding the creditor’s right,protecting the transaction safety and asserting the market credit.Article 20 in our new Property Law prescribes the application scope,occurrence,validity and invalidity of the preliminary registration.Its con-tent is comparatively in integrity and has the positive significance,and it still needs further perfecting through judicial practice....
