摘要
行政指导的行为性质应打破传统事实行为的瑕疵性界定而归入行政行为的范畴,将行政指导纳入行政诉讼受案范围符合宪政以及信赖保护原则的要求,国内外现实与理论环境已经为我国行政指导可诉提供了可行性条件。为此,我国有必要从受案范围、原告资格、司法审查以及适用法院调解方面来构建相关行政指导诉讼的规则。
Administrative guidance ought to be categorized into "administrative action" according to its active attribution, thus the breakthrough to defectively traditional definition that administrative guidance belongs to factual action will be made. It will meet the demands of constitutionalism and the fundamental of credit security to add administrative guidance into the suable scope. The practical and theoretical circumstances, abroad and home, have been feasible for the suability. Therefore, it is needful to constitute the regulations in the aspects of suable scope, plaintiff qualification, judicial review and applicable judiciary mediation.
