摘要
网络技术对作品的创作成本、合理使用范围、为“个人学习、研究或欣赏”法律条款内容提出了挑战。我国可以借鉴美国版权法中合理使用判断标准,还需考虑个人使用作品及其对享有版权作品的潜在市场和价值的影响。
The network technology has challenged the legal provisions of the cost of creation, the scope of rational use, and the personal use, research and appredation of works. We could learn from the fair use of the judicial standards in American Copyright Act. Meanwhile, we should pay special attention to the personal use of the works and thor effect on the potential market of the oopyrighted works and their value.
