摘要
对民办教育进行行政管理的各有权机关之间以及教育行政部门的内设机构之间,存在职能界限不清、权责不明、权力交叉、多头管理、无人负责等现象。这表明民办教育中依法行政的基础较为脆弱。而要夯实民办教育中依法行政的基础,首先应转变立法观念,提高对民办教育及《民办教育促进法》的认识;在此基础上,再通过修订法律法规来消解现行法律规范在此方面存在的缺陷和冲突。
According to our investigation to the private education, there are phenomena that function is unidentified, power is cross, management is multiple, nobody is responsible for it and so on among the administrations which have power to administer the private education and among the inner mechanisms of educational administrative department. It indicates the base of administration according to law in private education is poorer. These phenomena are not in favor of managing and developing private education. To overcome the passive phenomena and to fasten the base of administration according to law in private education, we should change our idea in making law, raise the understanding to private education and to "The Law of Promoting Private Education" at first, then eliminate the defects and conflicts which exist in the current legal norm through revising the laws and regulations.
