摘要
通过中部某省三个村庄的土地调整显示,农村土地问题并不只是农民权利问题,而是与村组权力相关联,农民的土地权利是以村组的土地权力为保障的。村组的土地权力在当代中国农村主要表现为村组的土地调控权,这种乡村地权是当代村组得以维系的基础,是农民“成员权”意识的主要来源。在当前的农村土地制度中,农民土地权利与村组土地权力是相辅相成的两个方面,农民土地权利需要村组权力的保障才能得以实现,而只有保障了农民的土地权利,村组的土地权力也才具有合法性。
The main point of view in academic community believes that the problem of rural land is just the problem of farmer rights, but the adjustment of land in three villages of central china displays that the problem of rural land is not only the problem of farmer rights, but is associated with the power of village, the village＇ s right of land is the guarantee of people＇ s rights of land. In china rural area today, the village＇ s power of land is mainly embodied in the village＇ s rights of land controlling, which is the basic of village maintaining at the contemporary era, and which is the main resources of ＂member rights＂ consciousness. Since distributing the land to all of the people, the reform orientation of country land policy is emphasizing peasant＇ s rights of land, weakening the village＇ s power of land. In currant rural land system, peasant＇ s rights of land and village＇ s power of land are two aspects which supplement each other, peasant＇ s rights of land need the supportment of power of village, only that can it be achieved.
