摘要
调解制度是古代中国最具有文化代表性和最富有文化韵味的冲突解决方式。我们必须在坚持完全自愿、注重效率、程序规范、相互协调等原则的基础上,对传统调解制度进行创造性转化,使之在建构社会主义和谐社会时发挥更大的功效。
As a common way of conflict solving,mediation has been regarded as the best representation of the tradition and culture of anchient China. It fits for our national character and mental requirement. Nowadays, regarded as ＂the east experience＂ and imitated by ADR in other countries,the system of mediation manifests more and more vitality. At present,we should reform the traditional system of mediation in a creative way based on the principles such as complete willingness, high efficiency, normative procedure,mutual harmony,and so on. This will be very helpful in constructing the socialist and harmounious society.
