法的确定性与不确定性——英国国际私法之排除外国法适用研究

摘要关于外国法的排除问题,英国目前不仅在判例法上确立了许多明确的规则,而且在成文法中也作出了许多明确的规定,较为理想地实现了法的确定性与不确定性之间的平衡。我国目前有关直接排除外国法适用的立法亟待完善,毫无疑问,英国国际私法的相关规定对我国的理论与实践具有非常重要的借鉴意义。
