摘要
武装冲突法是国际公法的重要组成部分,各国的适用实践事关国家主权、安全和军事战略,更关涉对武装冲突法规则的遵守和执行。美国以国内立法明示武装冲突法条约的适用条件,以实用主义作为适用武装冲突法的基本原则,以双重标准作为适用的主要策略,大肆利用和挖掘武装冲突法服务于美国国家战略的工具价值,美国的做法值得注意。作为国际社会负责任的大国,我国应以美国为鉴,加强这方面的工作。
The law of armed conflict （ LOAC in short ） is part of public international law, and the applying strategy of contracting states concerns their respective national sovereignty, national security., military strategy, and esp. the respect and enforcement of LOAC. The United States of America acknowledges the applying conditions for the treaties of LOAC by its national laws, abiding by the basis principles of pragmatism, and using ＂ double standards＂ as its main strategy in its applying of LOAC, utilizing and excavating the instrumental values of LOAC to serve for the American national strategy. Attention should be paid to it. As a big power in the international society, China should learn the lessons from the USA, and strengthen our work in this field.
