摘要
本文论述了《村民委员会组织法》中罢免制度的理论基础和实践意义,分析了罢免制度运作的现状,提出了现行罢免制度中的程序缺陷,归纳出罢免程序三个阶段十二个争议较大的问题,提出了完善罢免制度的立法建议,以期在《村民委员会组织法》修订过程中能够完善罢免制度。
This paper focuses on the theories and practice of officer removal system in Villagers＇ Committee Organization Law, analyzing its current advantages and defects, summarizing its 12 frequently disputable questions in the three stages of deposal process, and offering some suggestions in hope that it can be improved in the future revision.
