摘要
煤矿安全规制是纠正市场失灵、保障煤矿工人劳动过程中健康和安全的重要手段。本文首先分析了煤矿安全市场的运作机制,从理论上论证了煤矿安全规制的必要性;讨论了煤矿安全规制的标准设计,推论出基于绩效导向、既有效果又有效率的煤矿安全规制的重要性;最后分析了潜在的煤矿安全规制失灵及其制度补充,试图为我国煤矿安全规制制度建设提供一些理论启示。
Coal mine safety regulation is an important instrument to correct market failure and to protect miners＇ rights of health and safety in the course of mining. First, this paper analyzes the mechanism and the failure of coal mine safety market, and thus demonstrates the theoretical foundation for coal mine safety regulation. Second, this paper discusses the criteria of coal mine safety regulation. Performance-orientated regulation with effectiveness and high efficiency is highly appraised. Thirdly, this paper discusses the potential regulation failure and the facilitating reform. This paper aims to provide some theoretical implications for China＇s coal mine safety regulation.
