摘要
地方立法中的部门利益倾向已成为制约地方立法步伐和立法质量的突出障碍。实践中相当一部分地方性法规存在严重的部门利益倾向。地方立法中的部门利益倾向破坏法制的统一,妨碍社会主义市场经济的发展,降低立法效率和行政效率,损害公民、法人和其他组织的正当权益。我们应当防止和克服地方立法中的部门利益倾向。
The inclination to departmental benefit of local legislation has already become the conspicuous obstacle of local legislative process and of the legislative quality. Quite a few local regulations have a strong inclination of departmental benefit in practiee. The inclination to departmental benefit of the local legislation does harm the unity of legislative system, hinders the development of socialistic market economy, reduces legislative and administrative efficiency and damages the legitimate rights and interests of the citizens, legal persons and other organizations. Therefore, the inclination to the departmental benefit should be prevented and overcome in local legislation.
