摘要
阐述了公益诉讼的一般界说,介绍了公益诉讼在域外和域内的现状,分析了公益诉讼的动因、我国实行公益诉讼制度的障碍,最后对建立我国公益诉讼制度的思路和具体方案进行了探讨。
The paper starts with a general introduction to public interest litigation system, including its concepts, characteristics, and significance. It then reviews the current situation of this system at home and abroad, analyses the necessity of, and obstacles to implementing this system in China. Lastly, it discusses the concrete plans of establishing this system, including perfecting the provisions about litigants, widening the jurisdiction over the cases, completing the verification burdens, constructing restrictive and insurance system.
