摘要
法的现代性问题是当今法学的热点问题,其核心是理性问题。现代法治在促进社会进步与发展的同时又暴露出种种的缺陷。西方的一些学者对法的现代性问题进行了分析并提出各种解决方案。中国的现代法制建设面临着现代与反现代两种思潮,所以,我国的现代法制建设既要坚持理性的立场又要批判理性的局限性。
