摘要
物权行为是我国学界研究的热点问题,本文基于物权行为客观存在的立场,概念之于体系的基石作用,从物权行为、物权行为分离原则、物权行为抽象原则三个概念入手,分析物权行为理论的内部层次关系,试图厘清概念,梳理体系并且给出物权行为制度的全貌,避免因为断章取义或以偏概全带来的误解。同时本文指出不采纳物权行为抽象原则的物权行为制度也可成立。
The juristic acts of real right are a hotspot issue in China＇ s academic circles. Based upon the position of real right juristic acts as an objective existence and the foundation role of concepts in systems, the paper proceeded from the three concepts of real right juristic acts, real right juristic acts separation doetrine, and real right juristic acts abstract doctrine, analyzedthe internal leveled relations for the theory of juristic acts of real right, and tried to clearly define concepts, comb out systems, give a complete picture of the system of real right juristic acts, and avoid misunderstandings arising from out - of - context quotations or one - sided views. It was pointed out in this paper that the system of real right juristic acts can also be established without the adoption of the real right juristic acts abstract doctrine.
