摘要
预断排除规则是诉讼制度中保障公正审判的一项重要原则。预断排除规则的主要功能是维护审判中心主义,贯彻直接言辞原则。结合我国司法实践,本文就预断排除规则在我国的缺失提出了几点完善的建议。
This article introduces the basic content of the rule of prejudges removes, and think it a cardinal principle to safeguards the fair trial in the lawsuit system. The author believes that its main function is to defend the trial＇s center principle, implement direct words principle, points out its judicial practical flaw, and finally puts forward several proposals for perfecting it.
