摘要
随着经济的发展，我国海外直接投资迅速扩展，但我国现有的有关海外投资的立法存在严重不足，有必要在坚持有利于我国经济发展、倡导和监管相结合以及与国际法一致的原则的前提下，建构一个以《海外投资法》为根本法，以《海外投资外汇法》等诸多配套法为补充的、系统的法律体系。
With the development of our economy, the overseas direct investment of our country has been boosted rapidly. In China, there are no perfect legislation concerning the question. It points out special principles benefiting the economic development of our country, adapting our legal system to international legal principles and practices, and two key methods——drafting basic and serial law of Overseas Investment and Law of Overseas Investment of Foreign Exchange, harmonizing international treaty about the overseas investment legislation.
