摘要
由于效率取向的管理主义范式诸多显而易见的弊端,范式转型的迹象日益明显,寻求管理主义的替代范 式即宪政主义公共管理范式在当下不仅具有现实必要性,而且也具有理论可行性。支撑宪政主义公共管理范式的 理论基础主要有新公共服务理论、公民参与理论、多中心理论。宪政主义公共管理的基本理念主要体现为代表公 民权精神、公正与社会平等、法治与效率;其管理体制可设计为多中心的治理结构、交叠管辖的管理权限及程序性 正当的规则体系;其政府运行样态则具体表现为被动主义的行政立法、民主主义的行政决策、规则主义的行政执行 以及人本主义的行政沟通。
Because of the many evident drawbacks of rsanagerialism oriented to efficiency, the transition of paradigm is becoming more and more obvious. At present, seeking substitutional form of managerialism namely constitutionalism, not only has realistic necessities, but also has theoretical feasibilities. The theoretical foundation supportiug eonstitutionalism is mainly as follows: new public service theory, citizen participation theory, and many centers theory. The values of eonstitutionalism are mainly embodied as : civil rigbt spirit, fairness and tile social equality, rnle of law and efficiency. Its management system can be designed as : governance structure of many centers, administrative authority of overlapping governance and regulation system of procedural due process, its governmental operating mode is specifically embodied as administrative legislation of passiveness, administrative policy making of democratic, administrative execution of the regulation and administrative communication of humanism.
