摘要
当前我国关于死刑的争论,焦点是什么样的论据更有助于驳倒死刑保存论和中国如何实现废除死刑。废除死刑,还是保留死刑,从功利主义的角度作结论不是绝对的。认为死刑是否必要,是对死刑的功利之争;死刑是否正义是死刑存废的人道之争。但无论是功利之争还是人道之争,都能得出针锋相对的两个结论:死刑是必要的,死刑是不必要的;死刑是人道的,死刑是不人道的。随着中国经济越来越发达,人权思想深入民众,生命价值提高,人生观得到一定改变,死刑一定会在中国废除,中国废除死刑的道路是:严格限制———废除。
The focus of the dispute about death penalty is on what argument is more likely to outargue the argument for keeping death penalty and on how to succeed in abolishing death penalty. Whether to abolish or to keep death penalty is not absolute if concluding from utilitarian angle. The viewpoint that whether death penalty is necessary or not leads to utilitarian dispute over death penalty, and the viewpoint that whether it is just or not results in moral dispute over keeping or abolishing death penalty. But either utilitarian or moral dispute will both arrive at two tit-for-tat conclusions: one is that death penalty is necessary and just, the other is just the other way round. With China' s economy becoming increasingly advanced, thought on human fights being deeply rooted in public minds, value of life being hightened, and outlook on life getting changed to some degree,death penalty is sure to be abolished in China and the solution to China' s abolishment of death penalty is to be strictly restricted till abolished.
