摘要
目前,司法解释在我国的司法实践中发挥着不可替代的作用,然而司法解释是不是我国现行社会主义法的渊源,司法解释在我国现行立法中的地位如何,作者在总结部分专家、学者意见的基础上,提出本人初浅的看法和建议。
At present, judicial interpretation plays a nonreplaceable role in judicial practice of our country. On the basis of several professors and learners＇advice, in this article, the author comes up with his own view and suggestion about that whether judicial interpretation is the source of our present socialist science system of law, and its status in the present legislation.
