摘要
虽然关于片面共犯是否成立共同犯罪没有定论,但是有必要肯定片面共犯成立共同犯罪。片面共犯成立共同犯罪存在于片面帮助、片面实行,不存在片面教唆、片面组织。
Although there is much argument about the existence of one - sided accomplice in the theory of Criminal Law, this article holds that one-sided accomplice should be affirmed. And both one-sided implementation and one-sided accessory constitute one-sided accomplice with non-existence of one-sided organization and one-sided abetment.
