摘要
房地产泡沫是房地产价格在人为因素的作用下严重脱离其实际价值而持续上涨的不正常状态。房地产泡沫与开发商的非法炒作、过度投机、人们的非理性价格预期以及结构性失调有着直接的关系,但其产生根源在于法律制度的缺失与不完善。本文通过借鉴我国香港地区和新加坡的有关法律,在土地管理制度、房地产开发资金的使用方式、房地产金融体制、房地产市场交易、房地产税收改革以及住房结构性问题等方面,探讨我国防治房地产泡沫的法律完善问题。
The bubble of real estate is abnoromality state that real estate price sustaining rise for it is divorced from actual value by the artificial factor action .The bubble of real estate has direct relation with excess gamble of exploitation businessman,the price anticipation of non-logos and configuration malajustment,but the procreant root rest with lack and not perfect of legal system.In this thesis ,through use for reference relating law of Hongkong and Singapore ,probe into the problem of law perfected in avoiding real estate bubble ,these problems including the system of glebe management,using fashion of exploitation fund of real estate,the finance system of real estate,the market trade of real estate, the revenue innovation of real eatate and the configuration problem of real estate.
