摘要
自从宪法作为国家的根本大法问世以来,世界上许多国家都陆续以不同的形式,建立了审查一般立法或行政法规是否符合宪法的制度,通常称为违宪审查或合宪性审查,以保证宪法的最高法律效力和地位。本文从史学的角度考察了英、法两国宪法监督模式,并从理论上分析了其差别,这对于完善中国的相应制度具有一定的现实意义。
Since the constitution that was taken as the fundamental law of the state was first come out, some countries in different ways have established one after another the system of examining whether the general law-making and administrative regulations have corresponded to the constitution in the hope of standing. This article investigates the different supervision mode of the constitution with regard to the Britain and France from the angle of history science, has profound actual significance of perfecting the related systems in China.
