摘要
有罪判决证明标准是我国刑事证据理论研究中争议最大的问题之一。本文介绍了几种主要的有罪判决证明标准,并且考察了西方两大法系的有罪判决证明标准。在借鉴了西方两大法系的精华和总结我国有罪判决证明标准的不足的基础上,提出了建构我国有罪判决证明标准的具体构想。
Standards of proof in guilty judge is one of most talktive problem in the study of criminal evidence .The anticle introduces some major kinds of standards of proof in guilty judge ,and make an observation on the standards of two big systems.Based on (absorbing) the advantages of the two systems and analying defects of our standards of proof in guilty judge ,the author puts forwards (some) concret presumption to rebuild the standards of proof.
