摘要
土地承包经营权是建立在集体所有权之下的一种新型用益物权,其长期性和稳定性对于保持农村社会稳定、保证农业持续发展具有十分重要的意义。《农村土地承包法》赋予了农民长期而有保障的土地承包经营权,在权利的稳定性和权利的维护方面有了很大的突破,有利于进一步调动农民的积极性。但是,该法对土地承包经营权的性质界定及在妇女承包权益维护上仍存在着一定的缺陷。
The law grants farmers extended steady guaranteed right to the land and makes much advancement in right protection in which is deductive to mobilize farmers' enthusiasm. On the other hand, the law has some limitations in the definition of property and protection of woman's contractual right of land.
