摘要
现代诉讼程序有多方面的价值追求,而价值追求是通过一系列理性设计的功能机制来实现的。这些功能机制主要有:诉讼独立、诉讼中立、诉讼公开、诉讼仪式、尊重与直接话语交涉。由于上述诉讼机制的存在,现代诉讼程序的功能越来越强大,也越来越能够满足人们多方面的需要,因此其价值也体现为多个方面,主要包括对实体法的效用价值、息纷止争价值、法治价值、独立价值。这些价值在现代社会稳定社会秩序、实现法治文明、追求社会全面进步中具有不可缺少的积极意义。
Modern litigation procedures have many value aims, which are realized through a series of reasonable mechanisms. These functional mechanisms include independence of litigation, neutral of litigation, open of litigation, and rites of litigation, respect and direct communication. As a result of those mechanisms, modern litigation becomes more and more powerful and then meets the needs of people in many ways. Therefore, modern litigation procedures have multiple values. Those values are crucial to maintain social order, realize rule of law and push social progress.
