摘要
城市房屋拆迁以城市建设为其实施的前提条件。我国宪法所规定的征收、征用制度实施的法定前提条件为“公共利益的需要” ,因“城市建设”的内涵远比“公共利益的需要”宽泛 ,致使拆迁制度与宪法相抵触 ,成为一个违宪的制度。根据《立法法》的有关规定 ,它面临改变与撤销这两种可能的归属。事实上 ,拆迁制度将不能合流的不同法律关系强行撮合在一起 ,这就决定了拆迁制度的归属只能是撤销 ,而不能是改变。相应的法律变革思路应当是 ,遵循不同性质法律关系的指引 。
盪rban construction” is the factual premise of urban house-dismantling and resident-removing brought into effect. Our country′s constitution stipulates that the legal prerequisite of levy and expropriation is ”need of the public interest”. Because the connotation of ”urban construction” is far more wide than ”need of the public interest”,urban house-dismantling and resident-removing system conflicts with the constitution and becomes a system in violation of the constitution. According to related stipulations of Legislation Law, it faces the two kinds of possibilities—being changed or being abolished. Based on deconstruction analyses, it can be found that urban house-dismantling and resident-removing system forcefully put the different legal relationships which can not “flow together in a same riverbed” into the system. This point had decided that urban house-dismantling and resident-removing system can only be abolished rather than changed.The corresponding legal transformation must follow the directions of different legal relationship to establish and consummate corresponding legal departments.
