摘要
人类历史上出现了两个刑罚适用原则:罪行均衡和刑罚个别化。罪行均衡主张刑罚应当与犯罪行为的社会危害性相均衡,刑罚个别化主张刑罚应当与犯罪人的人身危险性相均衡。两者产生于不同的时代背景,体现了对犯罪现象的不同认识水平,均具有一定的真理性。罪刑均衡与刑罚个别化是世界各国和我国共同的刑罚适用原则。
There are two principles of the punishment uses: the balance of crime and punishment and the personification of punishment. The former claims the balance between punishment and harm of crime, the latter claims the balance befween punishment and the threat of criminal. The two principles which reveal some rightness came from different social environment, reflecting the different levels of recognizing the crime, both have some rightness. Now in both all western countries and China, the principles of punishment uses are the balance of crime and punishment and the personification of punishment.
