摘要
自然人的缔约能力状态不仅影响了对其所缔结的合同效力的评判,也涉及到对相关合同主体权益的保护问题。我国现行法律有关自然人缔约能力的规定过于简单、抽象,借鉴有关先进立法例的做法,完善我国的自然人缔约能力制度,应是完善合同法的重要内容。
The state of natural person's covenant ability not only affects the judgment on contract but also influences the rights of parties concerned.It is necessary for us to use the advanced legislation,and consummate the system of the natural person's covenant ability as the important part of the contract law.
