摘要
文章从实证考察入手,提出并从理论上认识前期物业管理协议法律上所存在的立法和司法的局限性;指出纠正这些局限性主要须树立向业主这类弱势群体倾斜的理念,修改不明确的立法内容;同时,法官应做出正确的司法思维和决策,协调好房地产开发中的各方利益关系。
This paper deals with the legislative and judicial limitations of pre-property management agreement,and how to recognize the limitations rationally through empirical study.The purpose of correcting the limitations is to establish a concept that is oriented to the vulnerable groups,like the proprietors,and to amend ambiguous legislative content.Thus,right judicial thinking can be achieved,proper judicial policy can be made and the interests of all parties in real estate development can be properly coordinated.
