摘要
智力残疾人作为残疾人就业群体中的困难群体,如何解决他们的就业和社会保障问题,应当深入研究和探讨,本文从特殊劳动的角度分析其表现形态和特征,将这种特殊劳动与一般劳动加以区别,从而界定其与福利机构的关系为从属于委托民事关系的特殊劳动关系,进而引申为一种特殊就业,以纳入国家社会保障的框架,使各方的合法权益得到保障。并通过规范这种特殊就业,帮助和促进智力残疾人早日回归社会。
Persons with mental disability are difficult to obtain jobs.It is quite worthy to discuss how to solve their employment and social security problems.This article mainly discussed the special labor on its forms and features.By distinguishing special labor from ordinary labor,it made the conclusion that the relationship between special labor and social welfare organization forms civil entrust relation,a special labor relation.From this conclusion,,the special employment should be brought into national social security framework so as to protect persons with mental disability's legal rights and help them return to the society.
