一、前言作为一种法律事实,强制变卖被扣押船舶将直接引起一定的民事法律关系的产生,并发生一定的民事法律后果。就申请扣船、申请卖船的原告而言,因此获得日后顺利执行胜诉判决的期待权;
This article put forward new points of view on the sequence of debt performance,which is nowadays in judicial practice,after forced sale of the arrested vessel.The article mainly discusses two problems.First,as a lien,the possessory lien on vessel should pre- cede other general creditor's rights.Second,when the obligatory right comes under legal protection it has the efficiency of excluding other obligatory rights so as to be satisfied prior to other“registered creditor's rights”. In conclusion the author brings up a suggestive sequence of debt performance.
