摘要
刑事法治是一个内涵十分丰富、具有多种规定性的概念。从静态方面看 ,是指社会的法律规范体系 ;从动态方面看 ,是指法律规范的实现 ,而贯穿始终的则是法律意识形态。因而刑法的现代化 ,不仅需要塑造现代刑法的精神气质 ,而且需要一个结构严密、层次分明、前后一致、相互联贯、和谐协调的现代化的刑事法律规范体系。实践证明 ,刑事立法的现代化是刑事司法现代化得以实现的先决条件。因此 ,明确刑事立法现代化的标志 ,研究刑事立法现代化的特征 ,对于当下中国正在进行的刑法现代化 ,尤其是刑事立法的现代化 ,无疑具有重要的实践意义和理论价值。
Criminal rule of law is a concept with rich connotation. From the static perspective, it refers to social legal norm system. From the dynamic perspective, it means the realization of legal norms full of legal ideology. Therefore, the modernization of criminal law needs not only the spiritual quality for modeling modern criminal law but also a modernized criminal legal norm system that is structurally well-organized, coherent, consistent, and harmonious. It has been proved in practice that modernization of criminal legislation is the prerequisite for realizing modernization of criminal judicature. Therefore, defining the symbols of modernization of criminal legislation, and studying the characteristics of the modernization of criminal legislation undoubtedly have practical significance and theoretical value to the modernization of criminal law, especially the modernization of criminal legislation conducted on a grand scale.
