摘要
纳米材料的科学研发与纳米产品的技术生产都不同程度的存有潜在风险,有效探寻纳米科技风险并澄明其法律规避对策成为纳米科技合宜性发展的关键。研究从纳米微粒的内部机体危害与纳米科技的外部环境危机来发掘纳米科技的潜在风险,并从自律范式的导出与他律范式的整合两个层面来省视纳米科技风险规避的理念路径,在此基础上,进一步从纳米材料的法制之源、纳米产品的法意之根与纳米认证认可制度的法理之路释义了纳米科技风险规避的法律对策,并对我国经济转型期中的纳米科技发展提出参考建议。
In the scientific research and development of Nanomaterial and the production of Nanoproducts,there are potential risks in different degrees.It has become the key to the appropriate development of nanotechnology to effectively explore the risks of nanotechnology and clarify its legal evasive countermeasures.The research examines the potential risks of Nanotechnology from its internal hazards and the external environmental crisis.Meanwhile the research studies the concept and path of Nanotechnology risk aversion from the paradigm of self-discipline and the integration of heteronomy.On the basis,the research further interprets the legal countermeasures of Nanotechnology risks from the source of the legal system of Nanomaterial,the legal ideas of Nanoproducts and the legal road of the authentication and recognition system.The conclusion provides some proposals for the development of Nanotechnology during our nation's economic transition period.
