摘要
法学方法作为一种研究和解析法学这一知识体系的具体手段,在西方法学的不同流派中呈现出截然不同甚至彼此对立的具体形态,他们分别以不同的哲学基础、理论预设和基本范畴展开了对法律世界的探索,在此,笔者选取了西方主要的三大法学流派所采用的研究方法——价值分析、实证分析和社会分析——展开了比较研究。
As a specific means to study and analyze the knowledge system of law,legal method presents totally different even opposite specific models.They explore the law world from different philosophical foundations,beforehand-set theory and basic category.In this paper,the author chooses the research method adopted commonly by the three western legal genres——value analysis,case analysis and social analysis to develop a comparative study of it.
