摘要
司法实践中,刑事撤案并不如刑事立案那样受重视,存在着撤案即错案、撤案不当、撤案不及时等一系列问题。要解决这些问题,就必须正视刑事撤案机制中存在的"法外司法"等打擦边球的隐性司法的做法,进一步明确撤案的本质,建立科学的衡量侦查质量的考核体系;对司法实践中检察机关建议公安机关撤案的不合法律规定的做法,予以坚决禁止;建立起完善的刑事撤案监督制度,从理念到立法,规范刑事撤案制度的相关问题。
