摘要
合同形式强制有存在的必要性,其功能的发挥借助于强制的合同形式所具有的法律价值,即对合同的法律评价所具有的影响力。我国合同形式强制规范存在结构不完备的缺陷,形式替代规则也对形式强制形成挑战。应当辨清合同形式的性质,对其法律价值重新定位,妥善处理合同形式强制与合同自由原则的关系,准确适用合同形式强制规则及形式替代规则。
