摘要
越南的刑事侦查讯问制度禁止侦查讯问在夜间进行,犯罪嫌疑人有权对侦查人员的提问保持沉默,犯罪嫌疑人的辩护人和法定代理人在侦查讯问时有权在场,确立了讯问录音制度,并通过刑事实体法与程序法紧密结合形成严格的违法讯问责任制度,在立法上形成了一套以保障犯罪嫌疑人人权和自愿陈述为特征的现代侦查讯问制度。中国的刑事侦查讯问制度相对来说存在较多的缺陷。
