关于我国女性就业歧视问题的法律思考 被引量:2

摘要 平等就业权是我国宪法赋予公民的一项基本权利,是提高女性的社会地位,实现男女平等的前提条件。在我国社会现实中,女性就业歧视问题仍普遍存在,而现有的法律制度在禁止女性就业歧视方面明显不足。因此,有必要从立法、执法和司法三个方面来解决女性的就业平等权,制定专门的反就业歧视法、建立专门的执法机构和健全女性就业歧视的司法救济途径,来完善我国保护女性平等就业权的现行法律制度。 The Equal right to employment is a fundamental right to citizens by the constitution,the prerequisite to improve female social class and realize the sexual equality in China.At present,the phenomenon of female employment discrimination is still widespread in our society reality,while the current law has some obviously deficiencies to forbid this issue.Therefore,it is necessary to resolve the female equal right to employment from the aspects of legislation,execution and justice by setting specific laws and establishing special organization such as the execution and judicatory relief for improving the existing legal system of protection the female equal rights to employment in China.
