摘要
随着市场经济的发展和虚拟角色的商业化运用,理论和实务界出现了一种新型权利——商品化权。目前,我国法律对其适用和保护尚无定论。虚拟角色商品化权可概括为将能够产生创造大众需求的虚拟角色及其一部或全部的确认因素进行使用或许可他人使用,以促进商品或服务销售的专有权利。分析各国对虚拟角色商品化权的应对,阐述现有法律框架下对其保护的局限性,指出虚拟角色商品化权应成为一种独立的知识产权,其具备了知识产权的共有特性,应当划入知识产权的范畴。
