摘要
从法治主义视角看,交通安全失信联合惩戒制度目前尚游离于法律与行政的中间地带;从行政过程论视角看,交通安全失信联合惩戒制度是内外部结合、多阶段多性质行为的集合。实践中交通安全失信联合惩戒制度存在法律依据不足、失信行为认定不统一、失信联合惩戒措施定性模糊且行为法根据不足、程序规制和救济机制欠缺等问题。通过明确其公法定位、提升立法位阶充足法律依据、统一失信行为认定标准、完善程序规制和救济机制等方式,将交通安全失信联合惩戒制度纳入现有道路交通安全法治体系,有希望与交通行政处罚、记分管理一起成为交通安全管理实效性保障制度的三大支柱。
From the perspective of rule of law, the joint punishment on traffic violations intervenes between law and administration. According to administrative process theory, it is a combination of internal and external administrative acts, and a set of multi-stage and multi-attribute behaviors. The joint punishment is facing some problems, such as inadequate legal basis, inconsistent identification of traffic violations, confusing characterization and insufficient behavioral law basis of joint punishment measures, and lack of procedural regulation and relief mechanism. By addressing them, the joint punishment, along with traffic administrative punishment and demerit points, will guarantee the effectiveness of the traffic safety management.
