摘要
刑事涉案财物处置与民营企业产权保护密切相关,我国立法在刑事涉案财物处置的民刑衔接方面存在诸多缺陷,对民营企业产权保护十分不利。这些缺陷包括涉案财物的民法属性未予重视,非原物型违法所得的责任财产功能被否定,追缴、没收的民法属性和民事法律后果缺乏规定,责令退赔、返还财产边界不清,赃款赃物的善意取得缺乏依据以及犯罪工具没收范围的确定标准缺失。应当通过完善立法,对上述缺陷逐一予以纠正。
The disposal of property involved in crime is closely related to the protection for property rights of private enterprises.There are many defects in China’s legislation in the linkup between civil law and criminal law in disposal of property involved in crime,which are very unfavorable to the protection of property rights of private enterprises.These defects include:the civil legal attribute of the property involved in crime is not valued,the liability property function of non-original illegal gains is negated,the civil legal attributes and consequences of confiscation and recovery are lack of stipulation,the boundary between ordering compensation and returning property is not clear,the acquisition of illicit money and goods in good faith has no basis,and the criterion for determining the scope of confiscation of criminal tools is missing.The above defects should be corrected by perfecting the legislation.
