摘要
新修订的《中华人民共和国体育法》增设了体育赛事组织者转播权的保护条款,为权利爆炸时代新兴权利的入法与解释提供了研究样本。赛事组织者对转播的权利意识萌芽于体育广播时代,随电视广播发展肇兴,域外各国在实践中探索出了不同的入法路径,使其受法律规制和保护。我国《民法典》编纂和《著作权法》修改时均未考虑体育赛事组织者相关权利的法律保护,本次《体育法》修订则最终实现了体育赛事组织者转播权的法定化。体育赛事组织者转播权是数据财产权利,权利客体是数据信息,在权利适用上,宜采“体育法+民法典”的适用路径,《著作权法》仅适用于赛事节目盗播类案件,《反垄断法》则用于要求权利人提供限定次数的免费播放渠道。体育赛事组织者转播权的入法及解释,提供了法律如何回应新兴权利诉求的实证范式。
The newly revised Law of the People’s Republic of China on Physical Culture and Sports adds articles on the protection of the broadcasting rights of sports event organizers,providing a research sample for the entry into law and interpretation of emerging rights in the age of rights explosion.Sports event organizers’awareness of broadcasting rights originated in the era of sports broadcasting.With the development of television broadcasting,countries outside China have explored different ways to enter the law in practice,making it subject to legal regulation and protection.The codification of Civil Code of the People’s Republic of China and the revision of the Copyright Law did not consider the legal protection of the rights related to sports events,and the revision of the Sports Law finally realized the legalization of the broadcasting rights of sports event organizers.The broadcasting right of sports event organizers is a data property right,and the object of the right is the data information.In terms of the application of the right,it is appropriate to adopt the application path of“Sports Law+Civil Code”.The Copyright Law is only applicable to cases of pirated broadcasting of sports programs,and the Anti-Monopoly Law is used to require right holders to provide a limited number of free broadcasting channels.The entry into law and interpretation of the broadcasting right of sports event organizers provide an empirical paradigm of how the law responds to the emerging rights demands.
