摘要
推进国家和社会治理现代化,要求刑事法制不断因时因势进行调整、完善,以适应社会发展变化需要,促进社会和谐稳定。刑事法制的调整和完善,首先要解决基本观念问题,即从国家基本政治制度和理念出发,充分考虑中国国情和文化特质,形成符合国家和社会治理需要的观念体系,使得刑事法制的理念要素定位准确、方向清晰,能够在冲突的价值中形成合理的衡平原则和具体规则,尤其要厘清和界定社会主义国家的刑罚目的、社会力量参与形式,以及合理划分治安权和刑事司法权的界限,同时要充分认识到刑事法制资源的有限性,在制度和机制的调整与完善中充分考虑各种约束条件,进而确保犯罪治理目标的实现。
To promote the modernization of national and social governance,the criminal justice should be constantly adjusted from the basic ideas to the mode in order to meet the needs of social development and change and promote social harmony and stability.In order to perfect the criminal justice,we should firstly solve the problem of basic ideas,that is,starting from the basic political system and ideology of the nation,taking fully into account the national conditions and cultural characteristics of China,forming a conceptual system that meets the needs of the state and social governance,so that they are accurately positioned,the direction is clear,and reasonable principles of equity and specific rules can be formed in the value conflicts.In particular,it is necessary to clarify and define the purpose of criminal punishments in socialist countries,the form of participation of social forces,and the reasonable division of the boundaries between the police power and the criminal jurisdiction.Meanwhile,we should fully realize the limited nature of criminal justice resources,and fully consider various constraints in the adjustment and improvement of the system and mechanism,so as to ensure the realization of the goal of crime governance.
